
Chippewa Falls (WQOW) - The City of Chippewa Falls is being sued. The group Concerned Chippewa Citizens filed a civil lawsuit against the city council Tuesday. The issue: the vote to approve the development of a sand processing plant in Chippewa.
That group is against the plant, and has already filed a similar lawsuit against the city's plan commission. In Tuesday's filing, the group is challenging a December vote to provide bonds for the project. It says city code requires council members to vote yes or no when approving something like that.
But it claims one member voted present, instead of yes or no. That vote ended in a tie, but the resolution was approved when the mayor broke the tie. The group says that present vote should have been recorded as a "no" vote, which means the resolution would have failed. The lawsuit is calling on the court to void the vote.
