UPDATE 2: Day 2 of Britton trial wraps up

St. Croix County (WQOW) – The trial for Jared Britton moves forward. 

Britton, a former UW-Stout hockey player, is charged with felony murder in the death of fellow student Bradley Simon. 

Simon was allegedly pushed while riding a bike.  He crashed into a concrete wall and died five days later from head injuries.  The incident happened after a night of drinking and a dispute at a Menomonie bar. 

The confrontation started with a comment by Simon to Britton about not wearing an undershirt. 

"He was kind of angry because some kid just called him out for not having a shirt on, so he was kind of angry," says Garrett Grimstad, a friend and former teammate of Britton's. 

Grimstad tried to get both sides to relax, but witnesses told the jury someone knocked a drink out of Simon's hand. 

"I started to hear verbal comments and mentions of a fight about to erupt," says Scott Crooker, Simon's friend.  "Pretty soon a glass got slapped out of Brad's hand and things escalated from there." 

Simon's friend, Joe Scanlin also tried to intervene, but members of Britton's group told him that his friend needed to learn a lesson.

"After that event, I talked to Brad and said we need to get out, but I didn't want us to leave towards the front because it was possible they'd be waiting at the front," says Scanlin.

Scanlin and Simon devised a plan to slip out the back of the log jam bar.  Simon left without Scanlin noticing.  Several minutes later, a bouncer says he saw Simon biking on a nearby street and Britton push him.

"Jared's body language during the shove, it seemed like it was a solid shove, it wasn't like he just bumped him," says JD Kuehn, an employee at the Log Jam Bar.

However, the defense is claiming self defense, and the bike had faulty breaks.  The day after the incident, Britton told police it was his friend Jed McGlasson who pushed Simon.

"That's when my friend noticed who he was, the guy earlier that started the incident in the bar and trying to give him a shove, I don't know if it was because he came to close to him," jurors heard Britton say in a recording played in the courtroom.

The prosecution rested late in the afternoon and the defense called its first witness to the stand, Britton's former hockey coach at UW-Stout.

"In your opinion, he isn't a violent person?" asked Earl Gray, Britton's defense attorney. 

Terry Watkins, UW-Stout men's ice hockey coach, responded, "I had not seen it, in three years I had not seen it at all."

Testimony could wrap up Thursday.  Britton's attorney says he isn't sure if his client will testify.  Britton's friend McGlasson was also charged in Simon's death.  His trial is scheduled for August.

Prosecutors say Britton intentionally meant to harm Simon, the defense says it was a "freak accident."

The prosecution continues to build its case against Britton.  An employee from the Log Jam Bar was on the witness stand as the day began.  The Log Jam Bar is a bar Britton and Simon were at prior to the bicycle incident.  The employee testified that he saw Britton push Simon while he was on the bicycle, seconds before Simon crashed into a concrete wall.

Also taking the stand during the morning was a business owner that witnessed the aftermath of the incident from his second story office.  He told the jury he heard a crash and comments about beating someone before going to his window.  There he saw someone standing over a person laying on the ground and yelling.

Jed McGlasson, a teammate of Britton is also charged in the death.  He's scheduled to go to trial in August.

Day two of the trial begins with an employee from the Log Jam Bar on the stand.  The employee kicked a member of Britton's group out of the bar after an incident with Simon.  He also witnessed the incident that caused Simon to crash his bike.

Jed McGlasson, a teammate of Britton is also charged in the death.  He's scheduled to go to trial in August.
