Menomonie (WQOW) - An area man who was ordered locked up indefinitely as a sexually violent
person, will get a new trial.
Montgomery Clark, from Menomonie, was
convicted of breaking into a woman's home and sexually assaulting her. That
happened in 2003.
Clark was scheduled to get out of prison
in 2008, but a jury found that he suffers from a mental condition that
makes it likely for him to re-offend. Clark
was ordered to be held indefinitely.
But this
week the state court of appeals granted Clark
a new trial on whether he should continue to be held. The court found the
presiding judge made several errors during the trial.
