Sand Speculation: What goes into a contract between a company and landowner


Eau Claire County (WQOW) - Applications for new frac sand mines may be leveling off, but that doesn't mean the search for sand is.  WQOW News 18 obtained a proposed contract between a frac sand company and an Eau Claire County landowner.

The contract from Procore Resources is written for the purposes of accessing and testing for sand.  Procore doesn't offer the landowner any money to take and test their sand which a local attorney said was a little unusual.  John Behling is with Weld, Riley, Prenn and Ricci.  He represents various interests in the frac sand industry.  Behling says a better contract would at least compensate the landowner for their time.

There's also a stipulation that prohibits the landowner from telling anyone but their lawyer about the testing.  One question is how far that restriction goes.  A group of citizens has raised concerns that some companies may not be sealing bore holes properly, which could present a risk to groundwater resources.  State law requires drillers to file a report once they abandon bore holes.

WQOW News 18 contacted Procore on Thursday, but did not hear back.  A copy of the contract has been posted with this story.
