Eau Claire (WQOW) - There was commotion in the courtroom during a hearing or a man charged with murder.
On Thursday, Larry Fernandez, from Ladysmith, was in court on charges of first degree murder. He's accused of strangling Frederick Harvey of Eau Claire. Harvey's body was found buried in Rusk County.
What was supposed to be a short hearing to set Fernandez' trial date, turned loud when Fernandez started shouting at the judge. Fernandez was upset that jail staff were not allowing him access to thousands of pages of paperwork related to his case. Jail policy is to limit access to three-hundred pages at a time. He shouted that the policy is infringing on his liberties to defend himself.
The court-appointed lawyer asked the judge to let him withdraw from the Fernandez case because of what he called a significant breakdown in communication. The judge granted that request. A new public defender will now be appointed. Another hearing is set for early February.
