Fatal crash suspect's payment reinstated license


MADISON (WKOW) -- Records show a suspect in a fatal crash in Sun Prairie was able to have his driver's license reinstated by making a payment to satisfy a court-ordered settlement amount.

27 News reported Tuesday 34-year old Jesse Bergeron had his license reinstated Sept. 14, despite pending felony charges involving his driving in last June's fatal crash; three, previous drunken driving convictions; and a separate speeding, and operating after revocation case last year. While an operating after revocation conviction would have likely continued to bar Bergeron from driving, a Dane County prosecutor agreed to a plea bargain to reduce the charge to a traffic ticket, and the court settlement was finalized in October. District Attorney Ismael Ozanne said even though Bergeron was charged in the fatal crash just days later, the separate plea bargain was initially struck before the crash took place.

Ozanne has yet to respond to questions from 27 News on whether he is considering asking a judge to modify Bergeron's bail conditions to bar his driving.

Records show state department of transportation officials suspended Bergeron's license in March 2010 for up to five years for Bergeron's failure to pay a judgment in a civil case involving a traffic crash.

Records show Bergeron paid $4,996 on Sept.12 to satisfy the judgment.

Bergeron's mother, Sheri Bergeron, told 27 News she and Bergeron's father provided the money for the payment so Bergeron could drive to work and maintain his job.

Fatal crash victim Kim Sylvia's daughter, Amanda Sylvia, launched the web site "Justice for Kim" to expose Bergeron's driver license reinstatement, despite his driving history.

Authorities say Bergeron failed to yield to a motorcycle as he made a left turn onto Highway 19, hitting the motorcycle, injuring its driver, and killing passenger Kim Sylvia.
