Rusk County (WQOW) - The case against an Altoona man allegedly involved in a close call with a school bus full of kids is now closed.

Rusk County prosecutors this week dismissed their case against Michael Malone because he died last month of cancer.

Last March a Bruce school bus driver was about to let kids off her bus when she noticed Malone's car passing her on the right hand side. She closed the door in time to keep the kids from stepping off. Their mother witnessed the near-tragedy then chased after the driver until she got his license plate number.

Malone was later arrested for 11th offense drunk driving. Both the mom and bus driver were awarded for their actions.
