Bus driver wins appeal in assault case

MADISON (WKOW) -- A Wisconsin appeals court rules in favor of a Milwaukee high school bus driver in a sexual assault case.

The driver, 26-year-old Gene Echols, argued a lower court failed to consider some evidence and unfairly used testimony in convicting him of sexually assaulting a student.

Wednesday, the 1st District Court of Appeals ruled a Milwaukee County Circuit Court lacked sufficient grounds to convict Echols of second-degree sexual assault and sexual assault of a child by a person who works with children.

In 2010, a high school female student accused Echols of sexual assault after the two got into an argument.  Echols says the lower court ignored evidence the student had a long history of disciplinary problems at school.

He also stated  the court unfairly used testimony from the school bus safety director who, according to Echols, had a history of lying.
