EAU CLAIRE - An area man accused of murdering an Eau Claire man will not stand trial on charges of threatening to kill the judge who is hearing the murder case.
Larry Fernandez was charged with making verbal threats against Eau Claire County Judge Lisa Stark. But Tuesday, a judge granted a defense motion to dismiss the charge. The judge found that Fernandez' statements were not a true threat because they were generalized and not specific to the judge.
Fernandez, who's from Ladysmith, is due back in court in April on charges that he strangled Brian Harvey and buried his body in Rusk County.
