Judge modifies Spear's bail, allows move to Texas

MADISON (WKOW) -- A Dane County judge modified the bail of a man accused of trying to kill his wife by setting her on fire, allowing the man to move to Texas if he wished.

Judge William Hanrahan continued a no-contact order between Andrew Spear and his wife, former department of health services chief legal counsel Mary Spear.

Spear has petitioned the court for an order allowing him to examine Mary Spear's computer data, phone records, and some medical history. Andrew Spear maintains his wife had an affair with former health services secretary Dennis Smith, an accusation Smith denies. Spear also claims his wife set the fire, and there was no murder attempt. She was only slightly injured.

A hearing on the request for the victim's records was postponed because the case's primary prosecutor, assistant district attorney Matthew Moeser, continues to serve as a prosecutor in the on-going child abuse trial of Chad Chritton. The trial has moved into an unanticipated third week of testimony.
