Man who killed neighbor with sword won't be released from mental institution

MADISON (WKOW) -- A man who killed his neighbor with a sword in 2009 will not be released from a state mental institution.

According to the Wisconsin State Journal, Zachary C. Schams and his lawyer, Assistant Public Defender Dennis Burke, conceded they don't have enough evidence to persuade a Dane County judge to release Schams from the Mendota Mental Health Institute.

Schams was given a lifetime commitment after being found guilty by reason of mental disease or defect. Investigators say he murdered Anthony Edlbeck, 31, in Sun Prairie four years ago.

The State Journal says Schams submitted a petition asking to be released in January. His victim's family was at a hearing Monday and told the court if Schams is released, he could commit other violent acts. An earlier petition for release by Schams was denied in December of 2011.
