WASHINGTON (WKOW) -- It's the first time since 1996 that an auto maker has challenged a federal recall order.
Chrysler is refusing a National Highway Traffic Safety Administration request to recall almost three million SUVs.
NHTSA says the gas tank design in 1993 to 2004 Jeep Grand Cherokees and in 2002 to 2007 Jeep Liberties is faulty and unsafe.
But the car maker says it's a commonly accepted tank design and used in many other vehicles.
It also says the fatal accidents involving the vehicles were almost all high-speed accidents in which a different design would not have made a difference.
The federal safety agency has not yet commented on Chrysler's statement.
