Husband charged in WI officer's death in court


MILWAUKEE (WKOW) – The attorney for an Iraq War veteran is trying to get his statements to police thrown out after he was charged with killing his wife.

Prosecutors say 30-year-old Ben Sebena acknowledged ambushing his wife, Officer Jennifer Sebena, while she conducted a pre-dawn patrol alone in Wauwatosa on Christmas Eve.

Ben Sebena's attorney has asked that those statements be thrown out and a judge will decide the issue during a hearing on Friday. 

Ben Sebena pleaded not guilty by reason of mental disease or defect to the charge of first-degree intentional homicide.  On Friday, attorneys are expected to talk about a report done by a forensic psychiatrist, who was supposed to determine if there was a basis to maintain the plea.

The trial is expected to start on July 8.
