Buffalo County (WQOW) - Frac sand has sparked a passionate debate from the bluffs to town board meetings. Last week, the issue was front and center in a Buffalo County courtroom.
A judge handed down a decision in a civil lawsuit.
The Cochrane-Fountain City School District claimed the Buffalo County Board of Adjustment said it would wait for a traffic safety assessment of Highway 88 before approving a permit for Glacier Sands. The highway has lots of curves and there are concerns about how it would handle extra truck traffic.
The assessment was finished about a month after the board approved a permit. The school district wanted the board's decision reversed.
A Buffalo County judge has denied that request. The judge said the board followed proper procedure and the plaintiffs did not prove the board's decision was arbitrary.
Right now, there are two active frac sand mines in Buffalo County and neither one is run by Glacier Sands. WQOW News 18 contacted the company to ask what it plans to do next, but have not heard back.
