Court dismisses lawsuit against Polk County over arrest


Polk County (WQOW) - A federal court dismisses a lawsuit filed by a Turtle Lake man who was falsely accused.

Paul Burritt sued the Polk County Sheriff's Office and an investigator.  In 2011, he was arrested and charged with sexually assaulting an 11-year-old girl.  The girl later confessed she made up the story and charges were dropped.  Burritt's lawyer says he never should have been arrested in the first place.

He sued for false arrest and violation of the Fourth Amendment.  He was seeking $4 million in damages. 

On Monday, the court dismissed the case.  One question was whether the law enforcement officer had probable cause to justify the arrest.  The court believes the investigator's actions were reasonable at the time.
