Appeals court affirms ruling in frac sand case

Buffalo County (WQOW) - The frac sand debate carries over into an appeals court.  That court has sided with a circuit court which upheld a decision to grant a conditional use permit to Glacier Sands in Buffalo County.

Opponents took the case to court claiming the Buffalo County Board of Adjustment said it would wait for a traffic safety assessment of Highway 88 before approving a permit two years ago.  The highway has lots of curves and there are concerns about how it would handle extra truck traffic.

A Buffalo County judge upheld the board's decision to grant the permit.  The judge said the board followed proper procedure and the plaintiffs did not prove the board's decision was arbitrary.  On Tuesday, an appeals court agreed.
