UPDATE: Byrd pleads guilty to second degree intentional homicide

MADISON (WKOW) -- 40-year-old Phillip Byrd has pleaded guilty in the death of his former girlfriend.

Prosecutors charged Byrd with first-degree intentional homicide in April in the February death of 43-year-old Cheryl Gilberg.

In court on Thursday, Byrd pleaded guilty to a reduced charge of second-degree intentional homicide in a deal with prosecutors.

The charge carries a maximum penalty of 60 years in prison.


MADISON (WKOW) -- A Massachusetts man is set to make a plea Thursday in the homicide of his former girlfriend in Mazomanie.

Dane County prosecutors charged Phillip Byrd, 40, with first-degree intentional homicide in April, claiming he shot Cheryl Gilberg, 43, during a struggle at her Mazomanie home in February.

Investigators wrote in court documents that Byrd told them he and Gilberg had magical chemistry together until she stuck her revolver in his mouth. He claims he knocked the gun out of his mouth and tackled her before the gun went off twice as they wrestled. He says he saw Gilberg lying on the floor, thought she was still alive and got frightened. He fled to another woman's trailer.
